QUEENSLAND.
CONVEYANCE OF MAILS, 1903, 1904,
and 1905.
SEPARATE Tenders are invited,
and will be received until
Noon of Saturday, the 27th day
of September, 1902,
for the Conveyance of Mails
(including Parcels), for one, two, or three years from the 1st January, 1903,
as hereinafter specified.
All Tenders must be written on
an approved form, printed copies of which may be had gratuitously, on
application at any Post Office in the State ; and may be forwarded (if by post,
prepaid), addressed to the Deputy Postmaster-General, Brisbane, with the words
“Tender for Mail Service No. .” endorsed on the cover, or may be placed in the
Tender Box at the General Post Office, Brisbane.
Tenderers are requested to
describe, by their numbers as below, the services for which they tender; and
every Tender will be taken to include the entire service as called for in each case.
Tenderers for horse services
will be required to carry parcels up to 3 lbs. in weight, and those who tender
for services by coach, buggy, or vehicle will be required to carry parcels up
to 11 lbs. in weight.
Tenderers must also state in
every case the means by which they propose to convey the Mails (including
Parcels), whether by horse or by coach or other vehicle.
Tenders on separate forms are
required for each service.
Every Tender must bear the bond
fide signatures of the Tenderer and two responsible persons willing to become
bound with him in such sum as the Postmaster-General may direct, not exceeding
the gross amount of the contract.
Accompanying every Tender, other
than from a person already holding a mail contract, there must be a certificate
by a magistrate or an officer in charge of a Post and Telegraph Office that the
Tenderer and his sureties are respectable and responsible persons. All Tenders
which do not comply with this condition may be rejected as informal.
Persons tendering, or their
agents, are required to be in attendance at the General Post Office, Brisbane,
on Monday, the 13th October next, and must then forthwith pay to the Postmaster
General a sum equal to 10 per cent. of the amount of such of their Tenders as
may be accepted, as a guarantee for their duly commencing and carrying on the
service tendered for.
The deposit shall be absolutely
forfeited to the Government in the event of the Contractor failing either to
complete the bond and contract within a reasonable time, or to commence the ser
vice on the date appointed.
The deposit will not be returned
until the contracts and bonds have been executed and the service has been in
operation for at least one month, to the satisfaction of the
Postmaster-General.
In the routes specified, only
the principal places of call are, as a rule, named; and no change must be made
in the route of a service as at present run without the express authority of
the Department.
Drivers of mail coaches will not
be required to leave the usual direct line of road for the purpose of receiving
or delivering private mails.
The General Conditions referred
to in the printed form of Tender can be inspected at the General Post Office,
Brisbane, or at any Post Office in the State of Queensland.
Contractors are bound to convey
all mails intrusted to their care irrespective of the number of horses or
vehicles required.
Tenderers are specially
instructed to state the frequency and mode of conveyance, and, when alternative
Tenders are invited, to give the distinguishing letter of the Service tendered
for.
The Postmaster-General will not
necessarily accept the lowest or any Tender.

The following are the General
Conditions to be observed by Contractors and referred to in the form of
Tender:—
1. The word
"Postmaster-General" in these Conditions shall mean the
Postmaster-General for the time being of the Common wealth of Australia; and if
there should be no such Postmaster General, or in the event of his absence from
the Commonwealth, then the word "Postmaster-General" shall mean the
officer for the time being having charge of the Post Office Department, by
whatsoever name he shall be called, and he shall have the same powers as those
vested in the Postmaster-General by these Conditions, in the same manner as if
his name had been inserted throughout these Conditions in the place and stead
of the word "Postmaster-General"; and the word "his" shall
extend to and mean "her" or "their," as the case may be.
The word "mail" or
"mails" shall mean all Post Office mail matter, mail bags, letters,
newspapers, packets, parcels, private bags, and Post and Telegraph Office
stores.
2. The times of arrival and
departure of mails to be on such days, and at such hour of the day, and from
and to and to and from such places inclusive, as the Postmaster-General shall
from time to time appoint; the Postmaster-General to have the power, during the
continuance of any contract, to alter and vary the days and hours of departure
as to him may seem fit, such alteration or variation to be carried out by the
Contractor without additional charge ; and the Postmaster-General may determine
the roads by which the mails are to be conveyed, and shall have the power of
ordering any deviation that may appear desirable, compensation for increased
distance consequent upon any deviation to be paid to the Contractor at the
contract rate per mile ; and all mails delivered to the Contractor before the
expiration of the last day of the period—including date timed for return to
point of despatch—for which the Contractor has agreed to carry and convey the
mails, shall be carried and conveyed to and delivered at their respective
destinations by the Contractor, although such period shall have expired while
the mails are in transit; and the Contractor shall be bound to convey such
mails, and perform all the usual services on the road, without charging for the
same; i.e., the all round trip to be performed and completed.
3. The Postmaster-General shall
be informed by the Con tractor of the name of every driver, mailman, or other
person intrusted with the custody of mails, and all such drivers, mail men,
&c., shall at all times be subject to the approval or rejection of the
Postmaster-General, or such person as he shall appoint for that purpose ; and
in case the Contractor shall dismiss any servant employed in the mail service
for misconduct or neglect of duty, the Contractor shall report the name of such
servant to the Postmaster-General, and such dismissed servant shall not be
re-employed by the Contractor without the sanction of the Postmaster-General.
4. The Contractor shall and will
find and provide all vehicles, boats, horses, drivers, and all requisites
necessary to carry his contract into effect, and will also provide secure
lockers or boxes and dry covering for the mails, and keep the same safe and dry
; and in every case, and as often as any mails shall be lost, or shall sustain
damage, by reason of the Contractor not providing good and secure locks or
boxes, and dry covering to keep the same safe and dry, or through any other
neglect of the Contractor, the Contractor shall be liable to a deduction of the
sum of Five pounds from money due or that may become due on account of his
contract or contracts.
5. The Contractor shall convey,
without any charge, in such vehicles and boats whenever so required, any
officer of the Post and Telegraph Department travelling on the service thereof
or on public duty, and also luggage for such officer not exceeding the usual
quantity allowed to passengers, inspectors of the Postal and Telegraph Service
to have the option of occupying a seat beside the driver of any mail
conveyance.
6. The means by which the mails
are to be conveyed shall, from time to time, and at all times, be optional with
the Postmaster-General.
7. The Contractor shall stop at
such place or places along the line of road or route as the Postmaster-General
shall direct, and shall deliver all mails which shall have been received by him
for delivery at such place or places, and shall also receive any mails which
shall be there tendered to the Contractor for delivery elsewhere.
8. The Contractor shall cause
all mails to be conveyed at such a rate of speed as the said Postmaster-General
may appoint, but not at a less rate than six miles an hour, or forty-eight
miles a day, and upon such days, times, and hours, and to such Post Offices or
places in or at and along the line of road determined by the
Postmaster-General, and under such directions as the Postmaster-General shall
from time to time for that purpose, by writing under his hand, direct and
appoint.
9. The Contractor shall, by his
agents, servants, and drivers, receive and take in charge all mails which
shall, under the authority or by direction of the postmaster for the district,
or other postmasters, be delivered to and placed under his charge for conveyance,
and shall, while under his charge, keep and convey and deliver the same at the
places on the days and at hours appointed by the Postmaster-General, in such
and the same condition as received, free from damage and loss.
10. Upon arrival at any place
where any mails are to be delivered, the horse, horses, or vehicles shall be
ridden, driven, or taken, by the Contractor, or his agent, servant, or driver,
direct to the door of the Post Office or place appointed for that purpose, and
the said mails must be delivered thereat before stopping at any other place
whatsoever.
11. The Contractor shall not
assign or part with his contract, or sublet the same or any part thereof, nor
assign any of the moneys due or to become due thereon, except with the special
licence and consent in writing of the said Postmaster-General
for that purpose first had and
obtained; and no such assignment without such licence and consent as aforesaid,
or any agreement, contract, or covenant for the same, or any irrevocable power
of attorney, or any power of attorney coupled with an interest to receive any
contract moneys or any part thereof respectively shall have any effect, or be
recognised by the Postmaster-General.
11A. In the event of a mail
Contractor being adjudicated insolvent, or whose estate is to be wound up in
liquidation, or in the event of the conviction of a Contractor of felony, mis
demeanour, or other indictable offence, the Postmaster-General reserves to
himself the right of cancelling any mail contract or contracts so far as such
Contractor is concerned, and at the same time holding the sureties or bondsmen
to their bond for the due fulfilment of the said contract or contracts.
12. The Contractor or the person
or persons employed in the conveyance of the mails shall, when thereunto
required by any postmaster, carry and deliver private mails to and at all
places situate on the line of road appointed by the Postmaster General ; and
shall also, when thereunto required by any person on the road beyond the
precincts of a post town, take in charge, receive, and deliver over to the
postmaster at the Post Office at which the Contractor or the person or persons
employed in the conveyance of the mails shall first arrive, all private mails
which may be tendered to the Contractor or the person or persons so employed to
receive and deliver the said mails. Provided that the Contractor or the person
or persons so employed shall not be required to deviate or depart from the
direct line of road for the purpose of receiving or delivering any private
mails, and the Contractor shall not receive or collect any charges or postage
for the same.
13. The Contractor or person or
persons employed in the conveyance of the mails shall carry in a leathern bag
in such a way as may be directed, and shall deliver loose letters, packets, and
newspapers to and at all places situate on the line of road ap pointed by the
Postmaster-General; and shall also, when thereunto required by any person on
the road beyond the precincts of a post town, take in charge, carry in a
leathern bag as before mentioned, and deliver over to the postmaster at the
Post Office at which the Contractor or the person or persons employed in the
conveyance of the mails shall first arrive, or, should no Post Office
intervene, at the places of address, all loose letters, packets, and newspapers
bearing the proper amount of postage (at inland rate), which may be tendered to
the Contractor or the person or persons so employed in the conveyance of the mails.
Provided that the postage stamps
affixed to any loose letters, packets, or newspapers other than those delivered
at a Post Office shall be obliterated or destroyed by the mailman in the
presence of the addressee or receiver before delivery of such loose letters,
packets, or newspapers.
Any mailman or other person in
charge of the mails who shall neglect or refuse to receive, carry, or deliver
any properly stamped loose letter, newspaper, or packet either given by a
postmaster or by any other person as aforesaid, or who shall receive or deliver
any loose letter, packet, or newspaper without the proper stamp affixed
thereto, or who shall neglect to obliterate or destroy postage stamps as
required by this condition shall, in every case, and as often as such shall
happen, forfeit and pay to the said Postmaster-General a sum not exceeding Five
pounds for each said letter, packet, or newspaper. Provided also that in the
case of any telegrams, letters, packets, or newspapers which have been received
through the medium of a post by the owner, occupier, or manager of any house
licensed under The Licensing Act of 1885, or any Act amending or in substitution
for that Act, or at any house at which lodgers are received and are tendered by
such owner, occupier, or manager to a mailman or other officer in charge of
mails for the purpose of being conveyed to the nearest Post Office in
conformity with section 47 of the Post and Telegraph Act 1901 (No. 12 of 1901),
it shall be the duty of such mailman or other person to take charge of, carry,
and deliver the same to such nearest Post Office (as hereinbefore defined),
without requiring such owner or manager to affix any postage thereto.
The provisions of this clause
shall also apply to parcels where the service is intended for the conveyance of
parcels as well as mails.
14. All vehicles, horses, boats,
and other requisites to be employed in the conveyance of the mails shall at all
times be subject to the inspection, and be liable to the approval or rejection,
of the Postmaster-General, or such person or persons as he shall appoint for
that purpose.
15. The Contractor shall not
carry or convey, or allow to be carried or conveyed, in and by any one of the
vehicles employed in the mail service, a larger number of passengers, exclusive
of the driver, than authorized by the said Postmaster-General, nor allow the
said vehicles to be loaded with luggage. And in the event of any delay ensuing,
or being likely to ensue in the de livery of the mails at their destination
from the carrying of passengers in the said vehicles, the Postmaster-General
may limit the number of such passengers or forbid any being carried or
conveyed, and that no authority granted for passenger traffic shall be taken as
an excuse for failure in the due performance of the mail service or of this
contract. And if the Contractor or the driver of any of the said vehicles shall
at any time permit or suffer a greater number of passengers or quantity of
luggage or goods than authorized by the Postmaster-General to be carried or
conveyed therein, the Contractor shall forfeit and pay a sum not exceeding
Twenty pounds for every such passenger, or corresponding weight of luggage or
parcel, so carried or conveyed beyond the number so authorized.
16. The Contractor shall not
receive or convey, or permit to be received or conveyed, either directly or
indirectly, any letters or packets containing letters, or any articles subject
to postage, except such as shall have been delivered under the authority or by
the direction of the postmaster for the district, or his deputies, and except as
hereinbefore excepted; and that in case the Contractor shall allow his
servants, agents, or drivers to con vey such (unless under instructions from
the Postmaster-General, or his authorized officer, in writing), the Contractor
shall forfeit 10 per cent. on the amount payable for the service on the road or
combined roads on which the offence may have been com mitted ; and the
Contractor shall also forfeit and pay a sum not exceeding Five pounds for each
letter, packet of letters, or articles subject to postage so received,
conveyed, or delivered, either by him or his agents, drivers, or servants,
contrary to these conditions, and also the like penalty for every failure in
the delivery or conveyance of loose letters and bags duly tendered according to
custom.
17. Every vehicle employed in
carrying the said mails shall have painted on the door or body thereof, in
words at length, the number of passengers permitted to be carried by such
vehicle, together with the words " Royal Mail," and the Royal Arms,
painted in a conspicuous place; and all mounted postmen shall wear such badge
(to be provided at the expense of the Contractor) as the Postmaster-General
shall direct.
18. The drivers of the said
vehicles, and the riders of the said horses, shall be provided with a horn,
which shall be sounded to give notice of the approach of the mail to the
different stations, and to clear the road from obstructions to its progress.
19. The Contractor shall forfeit
and pay the sum of Five shillings for every five minutes' delay (after the
first five minutes) from the specified time of starting or receiving the mails,
unless such delay be caused by the instructions of the Postmaster General or
one of the district postmasters, or awaiting the arrival of an overdue mail.
20. The Contractor shall forfeit
and pay the sum of Five shillings for every delay of ten minutes (after the
first ten minutes) from the specified time for the delivery of the mails
(unavoidable accidents and such delays as may be occasioned by the postmaster
in delivering the said mails always excepted), unless the delay be under the
authority of a member of the Post Office Department; and the certificate of the
officer of the Post Office Department under whose notice the irregularity comes
is to be taken as evidence and proof of the time of arrival or departure.
21. In the event of the
Contractor neglecting to provide all such vehicles, horses, drivers, lockers,
boxes, dry covering, and requisites, as may be deemed necessary aud requisite
by the Postmaster-General for carrying out this contract, or to convey the said
mails on the days, at the times, and in the manner hereinbefore set forth, it
shall and may be lawful for the Postmaster-General, at the expense of the said
Contractor, to procure the said mails to be carried, and to deduct the costs
and charges occasioned thereby from any payment to be made to the said
Contractor under his contract. And the Contractor shall also forfeit and pay
the sum of Ten pounds when and as often as any such deficiency as aforesaid shall
occur.
22. The Postmaster-General shall
have the power to deduct from any amounts falling due to the Contractor any sum
not exceeding Ten pounds for any breach whatsoever in this contract not
hereinbefore specially provided for; and also, that it shall be lawful for the
Postmaster-General, from time to time, to appoint any person or persons to
perform all or any of the acts required under this contract to be performed by
him.
23. Should any mail be lost
while in the custody or possession of the Contractor, it shall and may be
lawful for the Postmaster General to offer such reward as he may deem fit for
the recovery of the same, such reward not to exceed Twenty pounds and to pay
and deduct such reward out of any payments to be made to the Contractor under
his contract.
24. All or any of the penalties
or forfeits and sums of money, although arising from the neglect, or
misconduct, or breach by drivers or servants, shall or may be imposed and
declared forfeit, and levied by the said Postmaster-General or any person or persons
appointed by him for that purpose, upon his or their sole authority; and all
such sums of money so imposed and declared forfeit shall and may be, by the
said Postmaster General, deducted and received from all or any of the payments
to be made to the Contractor under and in pursuance of his contract; and it
shall and may be lawful for the Postmaster General to deduct the same, or to
proceed for the recovery thereof in any court of law in the State of
Queensland.
25. All fines and forfeitures
hereby imposed are to be paid over and above all other penalty or penalties
imposed by any Act or Acts of the Legislature of the Commonwealth. Provided
that the Postmaster-General may at any time remit any penalty or penalties, sum
or sums of money, imposed or declared forfeited by virtue of these conditions.
26. In all cases where it may be
at any time practicable for the Government of the Commonwealth to convey any
mails by rail way, either for the whole or for any part of the way by direct
route or otherwise, the Postmaster-General shall in the former case have power
to terminate the contract, and in the later case a rateable mileage reduction,
to be settled by the Postmaster General, maybe made from the payments to the
Contractor, and the Contractor will be required to take up and receive the
mails at any part of the road to which the railway communication shall extend.
The Postmaster-General shall at any time during the continuance of this
contract have the option of re-arranging, increasing the frequency, and of changing
the routes of the ser vices to be performed thereunder, or of reducing the
frequency thereof; and if such re-arrangement and change of route shall
increase or lessen, or if such reduction in frequency shall lessen the distance
to be travelled by mail vehicles or horses, or if the
frequency be increased, a
proportionate increase or reduction, as the case may require, may be made in
the amounts to be paid under this contract, computed upon the basis of the
mileage rate of the contract. The Postmaster-General may, however, contract or
agree with any person other than the Contractor for any increase in the
frequency of such services; and the Contractor shall have no right to demand
that any increased frequency in any of the services contracted for by him shall
be carried out by him at the contract or any other rate.
26a. In the event of it being
found necessary, from any cause, to absolutely cancel a contract, the
Postmaster-General shall have full power to do so, provided that, unless the
contract be cancelled on account of any fault on the part of the Contractor,
payment shall be made to the Contractor as compensation of a sum equal to 10
per cent, of the moneys which would have become due on the unexpired period of
the contract if the latter had been continued for the full term for which it
was accepted.
27. Upon the Contractor
performing the contract, the amount for which the Contractor in the tender
offers and agrees to perform the services required will be paid to the
Contractor by equal quarterly payments, less any sum or sums to be deducted for
fines, forfeitures, or penalties
28. The Postmaster-General will
not pay ferry or any other dues that may be incurred by the Contractor or his
servants in the performance of his contract.
29. The Contractor shall not' be
entitled to claim any extra payment on account of the removal of any Post or
Receiving Office during his contract, unless such removal shall increase the
length of the service (one way) to the extent of at least one mile.
30. No mailman shall carry
intoxicating liquor except in cases and in quantities of not less than 2
gallons, nor shall he carry it for disposal by him, either by sale or
otherwise, but only as a carrier for the sender or consignee. He is also
prohibited from carrying opium or any preparation thereof, unless medicinal.
31. The way-bills are to be
handed to every postmaster on the line of road, or where required, for the time
of arrival and departure to be filled in, and must be delivered to the
postmaster at the terminal office. The Contractor will be fined Ten shillings
in every case where he fails to produce the waybill, and the loss of the same
will not be taken as an excuse.
32. When it is not practicable
for mails to be conveyed by vehicle, Contractors must make provision for their
conveyance by packhorse or other means.
33. Only white labour is to be
employed in the conveyance of mails, and such rates of wages are to be paid and
such working conditions observed as are recognised in the locality in which a
contract is being carried out.
34. No application for a
transfer of a contract will be entertained until a fee of Ten shillings has
been paid on a contract not exceeding £50 per annum, and Twenty shillings on a
contract above £50 per annum.
35. In the event of death,
conviction, or bankruptcy of a surety, the Contractor will be required to name
another surety, who must be duly certified to by a magistrate or some well-known
person in the prescribed form. The Contractor and both sureties must then
execute a fresh bond, the stamp duty on which will be chargeable against the
Contractor.
36. Upon any neglect, or for any
breach or neglect of any of these conditions in addition to the penalties
hereinbefore mentioned it shall be lawful for the Postmaster-General to
terminate the contract; and any money due to the Contractor thereon shall be
forfeited by him.
